Terms & Conditions

1. About us
1.1 This website, www.martsella.com (the "Website"), is operated by Martsym Trade Ltd, trading as Martsella ("we", "us", "our"). We are a company registered in England and Wales under company number 15967593. Our registered office is Suite 13079, 43 Bedford Street, London, WC2E 9HA, United Kingdom.
1.2 You can contact us by email at info@martsella.com or by phone on +44 7488 818532.
2. These terms
2.1 These terms apply to every order you place on the Website. Please read them before ordering. By placing an order, you agree to these terms.
2.2 We sell to consumers only, meaning individuals buying wholly or mainly for purposes outside their trade, business, craft or profession. We deliver to addresses in Great Britain (England, Scotland and Wales) only.
2.3 Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2.4 We may update these terms from time to time. The version in force when you place your order applies to that order.
3. Products
3.1 We sell products from selected third-party brands. Products are dispatched directly to you by our supply partners from their warehouses. The country each product is dispatched from is shown on its product page.
3.2 Product images are for illustration. Colours and finishes may vary slightly depending on your screen. Product dimensions and specifications are shown on each product page.
3.3 Electrical products must be installed and used in line with the manufacturer's instructions. Some lighting products may require installation by a qualified electrician; where this applies, it is stated on the product page.
4. Placing an order and how the contract is formed
4.1 To place an order, add products to your basket, go to checkout, enter your details and choose a payment method. Before you submit your order, you can review and correct any errors.
4.2 When you click the button to place and pay for your order, you make an offer to buy the products. We will send you an email acknowledging your order. This acknowledgement does not mean your order has been accepted.
4.3 Our acceptance of your order takes place when we email you to confirm that it has been dispatched (the "Dispatch Confirmation"). The contract between you and us is formed at that point.
4.4 We may decline an order, for example if the product is out of stock, if there is an obvious pricing error (see clause 5.3), if we cannot deliver to your address, or if we cannot verify your payment. If we decline your order after taking payment, we will refund you in full within 14 days.
4.5 The contract is concluded in English. We do not file individual contracts; we will email you an order confirmation, these terms and our cancellation information so that you have a durable record.
5. Prices and payment
5.1 Prices are shown in pounds sterling (GBP).
5.2 Delivery charges depend on the product and supplier. They are shown on the product page where possible and always in your basket and at checkout before you pay. Any surcharge for delivery to the Scottish Highlands and Islands is also shown before you pay.
5.3 Although we work hard to show correct prices, errors can happen. If a price is obviously wrong and you could reasonably have recognised it as a mistake, we may cancel your order and refund any payment in full.
5.4 We accept the payment methods shown at checkout. Payments are processed securely by our payment provider, Stripe; we do not store your full card details. Payment is taken when you place your order.
5.5 Discount codes and promotions are subject to the conditions shown with them, cannot be exchanged for cash and can be withdrawn at any time, without affecting orders already placed.
6. Delivery
6.1 Delivery details, including estimated delivery times and charges, are set out on our Delivery Information page and on each product page.
6.2 Delivery times are estimates. Unless a different date is agreed with you, we will deliver your order within 30 days of the day after the contract is formed. If we do not, you may cancel the order and receive a full refund.
6.3 Orders containing products from different suppliers may arrive in separate parcels on different days.
6.4 Responsibility for the products passes to you when they are delivered to the address you gave us, or collected by you or someone you nominated. You own the products once we have received payment in full.
7. Cancelling your order before dispatch
You can cancel your order free of charge at any time before it is dispatched by contacting us at info@martsella.com. We will refund you in full within 14 days.
8. Your right to cancel after delivery (14 days)
8.1 You have the right to cancel the contract within 14 days without giving any reason. The cancellation period ends 14 days after the day on which you, or a person you nominate, receive the products. If your order arrives in several parcels, the period ends 14 days after you receive the last parcel.
8.2 How to cancel, how to return products and how refunds work are explained on our Returns & Refunds page, which forms part of these terms. A model cancellation form is available there, but you do not have to use it.
9. Faulty or incorrect products
9.1 We are under a legal duty to supply products that are of satisfactory quality, fit for purpose and as described. If a product is faulty, damaged on arrival or not what you ordered, you have rights under the Consumer Rights Act 2015, including:
- up to 30 days after delivery: the right to reject the product and get a full refund;
- after 30 days and within 6 months: the right to a repair or replacement, and if that fails or is not possible, a refund (which may be reduced after the first 6 months for use);
- up to 6 years: the right to claim for faulty goods (5 years in Scotland), although after 6 months you may need to show the fault was present at delivery.
9.2 We cover the cost of returning faulty, damaged or incorrect products. Please contact us as soon as reasonably possible after you notice a problem, with your order number and photos if available. This helps us resolve the issue quickly but does not limit your legal rights.
9.3 Faults caused by misuse, incorrect installation contrary to the instructions, accidents or normal wear and tear are not covered.
10. Product reviews
10.1 Only customers who have bought the product from us can leave a review: you need to be signed in, and your account must have a paid order containing that product.
10.2 We check every review before it appears and publish all genuine reviews, positive and negative. We do not change what you write.
10.3 We may decline or remove a review only if it contains offensive or unlawful content, personal data, links or advertising, spam, or content unrelated to the product or your purchase. We do not pay for or offer incentives for reviews.
11. Our liability to you
11.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious it will happen or both of us knew it might happen when the contract was made.
11.2 We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights, and for defective products under the Consumer Protection Act 1987.
11.3 We supply products for domestic and private use only. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
11.4 We are not responsible for delays or failures caused by events outside our reasonable control. If such an event occurs, we will contact you as soon as possible and you may cancel the contract and receive a refund for products you have paid for but not received.
12. Use of the Website
12.1 You may use the Website for lawful purposes only. You must not misuse it, attempt to gain unauthorised access to it, or introduce viruses or other harmful material.
12.2 All content on the Website, including text, images, logos and design, belongs to us or our licensors. You may not copy or reuse it for commercial purposes without our written permission. Brand names and trademarks belong to their respective owners.
12.3 Links to third-party websites are provided for information only. We are not responsible for their content.
13. Your personal data
We use your personal data as described in our Privacy Policy and Cookie Policy.
14. Complaints
If you have a complaint, please contact us at info@martsella.com.
15. Other important terms
15.1 We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens, and it will not affect your rights.
15.2 If a court finds part of these terms unlawful, the rest will continue in force.
15.3 These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland.
